Terms and Conditions
These General Terms and Conditions set out the terms and conditions applying to and governing the usage of the PHARE Rider and PHARE Driver apps – mobile technology that connects passengers with drivers to help them move around more efficiently.
Terms and Conditions for Riders:
By using the PHARE ride-hailing service as a rider, you agree to the following terms and conditions:
- Overview: PHARE Rideshare provides an information service through the PHARE app that enables mediation of the requests for transport services between the passengers and drivers. PHARE Rideshare does not provide transport services. Transport services are provided by drivers under a contract with passengers for the carriage of passengers. Drivers provide transport services on an independent basis as service providers. PHARE Rideshare is not responsible in any way for the fulfilment of the contract entered into between the passenger (you) and the driver. Disputes arising from consumer rights, legal obligations or from law applicable to the provision of transport services will be resolved between the riders and drivers.
- Payment: To use the PHARE ride-hailing service, riders must provide valid credit or debit card details upon registration. If riders wish to pay using cash, they must upload a selfie or photo clearly showing their face, and a copy of their ID (passport or national identification card) for verification by the PHARE team within a day or two. Riders are responsible for any fees charged to their card or for the cash payments made for their rides. If riders change the destination during the ride, additional fees will apply.
- Promotions: PHARE may send riders promotional codes that can be applied towards payment for rides. Expiration dates of promo codes will be shown in-app once you have applied the promo code to your account.
- Agent: PHARE Rideshare acts as a commercial agent for the providers of the transport services (drivers.) By joining the platform, drivers authorise PHARE as their commercial agent for the mediation of conclusion of contracts between the driver and the passenger and gives PHARE the power to accept payments from the passengers and to forward the payments to the driver.
- Cancellation: Riders may cancel a booked ride within 5 minutes of booking it and before the driver arrives, and will receive a full refund of fees charged to the app. If a ride is cancelled more than 5 minutes after booking, a cancellation fee may be charged.
- Damages: Riders are responsible for any damages or mess caused to the driver's vehicle during the ride. Riders may be charged additional fees to cover the cost of cleaning or repairing the vehicle in case of damage.
- Verification: Riders agree to upload accurate and verifiable information, including their name and card payment details, as part of the verification process. Riders must also comply with any additional verification requirements requested by the PHARE team for security and safety purposes.
- Personal Safety: Riders are responsible for their own personal safety during the ride. Riders should exercise caution, be respectful to the driver, and adhere to local laws and regulations.
Terms and Conditions for Drivers:
By using the PHARE ride-hailing service as a driver, you agree to the following terms and conditions:
- Use of the App: As a driver, you are authorized to use the PHARE app to accept ride requests from riders and provide transportation services. You must use the app in accordance with the instructions provided by PHARE and adhere to all applicable laws and regulations.
- Commission: PHARE will deduct a commission from all fares received by drivers for the use of the app.
- Bank Account: Drivers are required to have a valid bank account in their name where their earnings from the PHARE app will be paid into.
- Documentation: As part of the on-boarding process, drivers must provide the following documentation and information:
- A passport-styled photo of their face
- A valid police certificate of character
- An unexpired driver's license
- Proof of address
- Proof of vehicle ownership
- Details of the vehicle (make, model, colour, license plate number)
- Photos of the interior and exterior of the vehicle
- Copy of the vehicle insurance.
- Rider Verification: Riders are required to upload their credit or debit card details in order to use the app. If they wish to pay using cash, they will need to upload a selfie or photo clearly showing their face, and a copy of their ID (passport or national identification card) for verification by a member of the PHARE team within a day or two.
- Damage and Cancellation Policy: If a rider damages or dirties a driver’s vehicle, the rider will be charged an additional fee. If a rider cancels the ride within 5 minutes of booking and before you arrive, they will receive a full refund of fees charged to the app. If a rider cancels more than 5 minutes after booking, you have the right to charge them a cancellation fee.
- Safe Driving: Drivers must adhere to all traffic laws and regulations, prioritize passenger safety, and avoid reckless or dangerous driving behaviour at all times.
- No Solicitation of Payment: Drivers are strictly prohibited from soliciting or accepting any additional payment from riders outside of the PHARE app. All fares must be processed through the app, and drivers should not engage in any form of off-app payment arrangements with riders.
- Sobriety: Drivers must not operate a vehicle while under the influence of alcohol, drugs, or any other intoxicating substances that may impair their ability to drive safely.
- Sufficient Rest: Drivers are responsible for ensuring they are well-rested and in a proper physical and mental condition to drive. It is important for drivers to take breaks and get sufficient rest as needed to avoid fatigue and maintain safe driving practices.
- Professional Conduct: Drivers are expected to be courteous, respectful, and professional towards riders at all times. This includes using appropriate language, maintaining a clean and tidy vehicle, and respecting the privacy and personal belongings of riders. Drivers should not engage in any behaviour that may be considered rude, offensive, or discriminatory towards riders.
- Passenger Safety: Drivers are responsible for ensuring the safety of their passengers during the entire trip. This includes following all applicable laws and regulations related to child safety seats, seat belts, and other safety measures. Drivers should provide a safe and comfortable environment for riders throughout the duration of the trip.
- Reporting Incidents: Drivers should promptly report any accidents, incidents, or issues that occur during a trip through the PHARE app. This includes reporting any damage to the vehicle, disputes with riders, or any other incidents that may impact the safety or quality of the service provided. Timely reporting of incidents is crucial for resolving issues and ensuring the safety and satisfaction of riders.
- Confidentiality: Drivers should maintain the confidentiality of all rider information obtained during the course of providing transportation services. This includes not disclosing any personal or sensitive information about riders to third parties, and using rider information only for the purpose of fulfilling the transportation service requested through the PHARE app.
- Compliance with Laws: Drivers must comply with all applicable laws, regulations, and requirements related to their operation as a transportation service provider. This includes, but is not limited to, obtaining and maintaining all necessary licenses, permits, vehicle inspections and insurance coverage as required by law.
- Termination: PHARE reserves the right to terminate the driver's access to the app and services at any time for any reason, including but not limited to violations of these terms and conditions, unsafe or unprofessional conduct, or failure to comply with applicable laws and regulations.
- Amendments: PHARE may update or amend these terms and conditions from time to time, and drivers will be notified of any changes. Continued use of the app after such changes will constitute acceptance of the updated terms and conditions.
- Governing Law and Jurisdiction: These terms and conditions shall be governed by and interpreted in accordance with the laws of the jurisdiction where the PHARE service is provided. Any disputes arising from these terms and conditions shall be resolved in the courts of the jurisdiction where the PHARE service is provided.
By accepting these terms and conditions and using the PHARE app as a driver or rider, you acknowledge and agree to comply with all the above clauses and other applicable rules, policies, and guidelines set forth by PHARE Rideshare. Failure to comply with these terms and conditions may result in termination of your access to the app and services, and may also have legal consequences.
